1. About Carers' Link
Carers' Link ("we", "our", "us") is a platform where organisations or individuals ("Advertisers") may post roles for caregivers, and care providers ("Carers") may browse and respond to those postings. We provide an advertising and information service only — we are not an employment agency and we do not employ Caregivers or guarantee any engagement.
2. Acceptance of Terms
By accessing or using the app and related services (the "App"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, do not use the App.
3. Eligibility
- You must be at least 18 years old.
- Caregivers are responsible for holding any required licences, registrations, right-to-work permissions, and qualifications applicable in their jurisdiction.
- Advertisers are responsible for ensuring they may lawfully engage care.
4. Accounts
- You must provide accurate, current information when creating an account.
- You are responsible for safeguarding your login credentials.
- We may suspend or terminate accounts that violate these Terms or applicable law.
5. Job Postings & Interactions
- Advertisers are solely responsible for the content, accuracy, and legality of postings.
- We do not verify identities, backgrounds, qualifications, or legal status of users.
- We are not a party to, and are not responsible for, any communications, interviews, offers, contracts, or work carried out between Advertisers and Caregivers.
- We may remove content at our discretion where we believe it breaches these Terms.
6. Acceptable Use
You agree not to:
- Post false, misleading, discriminatory, harmful, or unlawful content.
- Harass, abuse, or harm others, or invade their privacy.
- Interfere with or disrupt the App, including by introducing malware or scraping without permission.
- Impersonate any person or misrepresent your affiliation.
7. Fees
Unless stated otherwise, use of the App is free. If we introduce paid features, fees will be disclosed at the point of purchase. Except where required by law, fees are non-refundable.
8. Intellectual Property
The App, including text, graphics, logos, and software, is owned by us or our licensors and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works except as permitted by law or with our prior written consent.
9. Privacy
Your use of the App is also subject to our Privacy Policy. Please review it to understand how we collect and use personal data. (For non-production testing, you may use a draft policy.)
10. Disclaimers
- The App is provided on an "as is" and "as available" basis.
- We make no warranties, express or implied, regarding the App, job postings, or outcomes, including suitability, availability, or reliability.
- We do not warrant that the App will be uninterrupted, secure, or free of errors or viruses.
11. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or exemplary damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the App, even if advised of the possibility of such damages.
12. Indemnity
You agree to indemnify and hold harmless Carers' Link, its officers, directors, employees, and agents from and against any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the App or breach of these Terms.
13. Changes to the App & Terms
We may modify or discontinue features without notice. We may update these Terms from time to time; the "Last updated" date will change accordingly. Your continued use after changes indicates acceptance.
14. Suspension & Termination
We may suspend or terminate access where we reasonably believe you have violated these Terms or applicable law, or to protect the App or its users.
15. Governing Law
These Terms are governed by the laws of the United States. You agree to the exclusive jurisdiction of the courts of the United States.
